A Commercial Drone Operator Must Be Certified

Here at Design Sticky Media, we recently received our F.A.A. part 107 commercial S.U.A.S. aerial drone airmans license. We were extra excited to find out that we were the first to become certified under part 107 in Columbus, Ohio. During our training, we discovered that a lot of agencies are offering commercial drone photography and videography for free to overcome the commercial regulations set forth by the F.A.A. There have even been a few agencies in Columbus, Ohio that have been operating under this type of mentality as reported here in Columbus CEO’s article for commercial drone operations. While this seems like a great approach, it does not alleviate you from the burden and fines applied from using an aerial drone commercially as the person(s) utilizing the footage shot from the aerial drone are also held accountable by the FAA and subject to hefty fines.

Is Your Drone Operator Certified By The FAA To Film Commercially?

There are two scenarios that come to play when hiring a non-certified aerial drone operator to capture your commercial photography and videography that could get you slapped with a fine from the FAA.

  1. The drone operator bundles their services and the aerial drone service has no extra charge. This scenario of drone operation still holds both the pilot and the person(s) utilizing the media captured by the aerial drone accountable, as both parties still utilized the drone footage commercially. While the actual drone footage was free, the video created using the footage was sold and used commercially. The same applies to the person who hired the drone pilot as they also have a commercial end use for the footage such as marketing, listing a home for sale or even adding footage to supplement a product for sale.
  2. The drone operator does not charge you anything for their services. Scenario 2 relieves the drone operator from all commercial uses of the drone as they have not made any money. Now all of the weight falls on the person who hired the drone operator as they will likely use the footage for commercial use.

How To alleviate Yourself From Possible FAA Fines

The answer to avoiding any fines when hiring an aerial drone operator for commercial use is to simply ask them if they are certified. Since entry to drone media is easy and cost effective, make sure you verify their certifications by asking them for their pilots certificate. They may have a temporary certificate while waiting on the official cert to arrive in the mail and that is ok. If they state that they are certified but do not have it with them then avoid their services, as it is a requirement that the remote pilot in command (drone operator) have their certificate on them when operating their aerial drone commercially.
